Terms and Conditions

These terms are the agreement between you and Pixeesoft GmbH, Rue Fendt 1, 1201 Geneva, Switzerland, for the use of Peyda Track. By creating an account or using the apps, you accept them.
This English text is the governing version. The Czech, Slovak, German and French versions are translations provided for convenience; if they differ from this text, this text applies.
Words we use

What the service does
Peyda Track shows you where a paired tracker last reported itself to be. With a subscription you can:
- See the tracker's last known position on a map.
- Replay roughly the last 30 minutes of its movement.
- Look back over the last 7 days of position history.
- See its battery over the last 24 hours and the last 7 days.
- Draw safe zones and be alerted when the tracker leaves or enters one, where your app version supports it.
That is the whole of it. The service reports what the tracker tells it and nothing more. It is not a security service, not an emergency service and not a substitute for looking after your animal. See the Disclaimer.
The tracker
The tracker hardware is bought separately and is not supplied under these terms. You pair it with your account by scanning the code that comes with it.
A tracker can only report a position when it has GPS reception, mobile network coverage and enough battery. Where any of those is missing, it reports nothing and the service shows you the last position it did report. Coverage depends on where the tracker is, and we make no promise about any particular place.
Your account
You create an account with an email address and a password, and you confirm the address before you can use the service. Give us an address you can actually receive mail at: it is how we reset your password and how we reach you.
Keep your password to yourself. You are responsible for what happens under your account. Tell us at track@peyda.app if you think someone else has access to it.
One account belongs to one person. You may not sell it, rent it or hand it to someone else.
Subscription and payment
Peyda Track is sold as a monthly or yearly subscription. You buy it inside the app, through the App Store or Google Play. We never see or handle your card or bank details; the store takes the payment and holds the payment method.
- The price is the one the store shows you at the moment of purchase, in your own currency.
- The subscription renews automatically at the end of each period until you cancel it in the store.
- Cancel in your App Store account settings or at Google Play. Cancelling stops the next renewal; the period you have paid for runs to its end.
- Deleting your Peyda Track account does not cancel the subscription. Cancel it in the store separately.
Refunds are handled by the store you bought through, under that store's policy. Any mandatory right of withdrawal you have as a consumer is unaffected.
Without a subscription you can still sign in and manage your account, but the tracker's detail view and its history stay locked. There is no way to buy a subscription on the web.
How you may use the service
Use Peyda Track on an animal in your own care. You must not:
- Use a tracker to follow a person, whether or not they know about it.
- Use a tracker on an animal that is not yours to look after.
- Take the apps apart, decompile them or work backwards from them.
- Call our API from anything other than our own apps, or collect data from the service automatically.
- Interfere with the service, get around its limits, or try to reach data that is not yours.
- Use the service to break the law where you are.
Tracking a person without their knowledge is unlawful in most places. If you do it, that is your responsibility, and we may end your account.
Availability
We work to keep the service running, but we do not guarantee that it is available at any given moment, or that it is free of faults. It may be interrupted for maintenance, by a failure at one of the services we depend on, or by something outside our control.
We may change, add or withdraw features. Position history is limited to 7 days by design: older records are deleted every night and cannot be recovered. If we withdraw something you paid for, you may cancel your subscription in the store.
What we do not promise
We do not promise that a position shown to you is accurate, that it is current, or that an alert will reach you at all or in time. What the service can and cannot do is set out in the Disclaimer, which is part of these terms.
Except where these terms say otherwise, the service is provided as it is, without any warranty that is not required by law.
Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under the law that applies to you.
Subject to that, we are liable only for loss we caused deliberately or by gross negligence. We are not liable for the loss of, injury to, or harm caused by an animal, for a position that was wrong, late or missing, or for an alert that did not arrive.
Where our liability can lawfully be limited in amount, it is limited to what you paid us for the subscription in the twelve months before the event.
If you are a consumer, the mandatory protections of the country you live in apply whatever this section says.
The apps
The apps are licensed to you, not sold. What you may and may not do with them is set out in the End User Licence Agreement.
Your data
What we do with your personal data, who receives it and how long we keep it is set out in the Privacy Policy.
Ending this agreement
You can end it at any time by deleting your account in the app. What that removes and what it leaves behind is described under Deleting your account. Remember to cancel your subscription in the store as well.
We may suspend or end your account if you break these terms, if you use the service unlawfully, or if we are required to. Where the circumstances allow it we will tell you first and give you a chance to put it right.
When the agreement ends, your right to use the service ends with it. The sections on liability, on your data and on governing law survive.
Changes to these terms
We may change these terms, for example when the service changes or the law does. The current version is always published on this page with the date it was last updated. Where a change materially affects you, we will say so on this site before it takes effect.
Prices are set in the store. If a price changes, the store tells you and asks for your agreement before it charges you the new amount. If you do not accept a change to these terms or to the price, cancel your subscription and stop using the service.
Governing law and disputes
These terms are governed by Swiss law. The courts of Geneva, Switzerland have jurisdiction over any dispute arising from them.
If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country you live in, and you may also bring a claim before the courts of that country.
Please write to us first at track@peyda.app. Most things are quicker to settle that way.
