End User Licence Agreement

Your licence

We grant you a personal, non-exclusive, non-transferable and revocable licence to install and use the Peyda Track apps on devices you own or control, for your own use, for as long as this agreement lasts. The apps are licensed to you, not sold.

You are responsible for making sure your device meets the requirements shown on the app's store page.

What you may not do

You may not:

• Change, adapt, translate or take apart the apps, or combine them with other software.
• Decompile them, disassemble them or work backwards from them, except to the extent the law says you may despite this clause.
• Copy, distribute, sell, rent, sub-license or otherwise exploit the apps commercially.
• Let a third party use the apps on their own behalf or for their own benefit.
• Remove or obscure any notice of ownership in the apps.
• Use the apps in a way that breaks the law where you are.

Who owns the software

We own the apps and everything in them, including the copyright and every other intellectual property right, and we keep that ownership however many times you download or update them. This licence gives you the right to use the apps; it transfers nothing else. We may license the software to other people.

Updates

This licence also covers updates, additions and supplements to the apps, unless one of them comes with its own terms. Where it does, those terms apply to it.

The app stores

You obtain the apps from the Apple App Store or from Google Play. The store's own terms apply to that download alongside this licence, and where the store's rules give you more than this licence does, the store's rules win.

A Peyda Track subscription is bought from and billed by the store, not under this licence. The subscription terms are in the Terms and Conditions.

If you obtained the app from the App Store

These points apply to the iOS app, and are required by Apple:

• This licence is between you and Pixeesoft GmbH only, not with Apple. Pixeesoft, not Apple, is responsible for the app and its content.
• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to conform to any warranty that applies, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind.
• Pixeesoft, not Apple, is responsible for any claim that the app or your possession and use of it does not comply with the law, is defective, or infringes a consumer protection or similar right.
• Pixeesoft, not Apple, is responsible for the investigation, defence, settlement and discharge of any claim that the app infringes a third party's intellectual property rights.
• Apple and its subsidiaries are third-party beneficiaries of this licence, and Apple may enforce it against you as such.

How long it lasts

This licence starts when you first use an app and runs until it ends. You end it by deleting the apps from your devices, or by deleting your account. We may end it if you break it.

When it ends, your right to use the apps ends and you must stop using them and remove them. The sections on ownership and on warranty and liability survive.

Warranty and liability

The apps are provided as they are. We do not warrant that they are free of faults or that they will run uninterrupted on every device.

Our liability under this licence is limited in the way set out in the Terms and Conditions. Nothing here removes a right you have as a consumer that cannot be removed under the law of the country you live in.

Governing law

This licence is governed by Swiss law and by the choice of court set out in the Terms and Conditions, with the same protection for consumers.
